At PURE we aim to provide the best possible client experience.

PURE provides access to the purespauk.com website (the "website") and sells products and services to you subject to the provisions set out in these terms and conditions. Please read these conditions carefully before using the purespauk.com website. By using the purespauk.com website, you signify your agreement to be bound by these conditions.

This website is owned and operated by The Nail & Beauty Zone Limited, trading as PURE (referred to as ‘PURE’ in these terms and conditions). Our registered office is 138 Lothian Road, Edinburgh, EH3 9BG. We are a company registered in Scotland, registration number SC225060. Our registered VAT number is 797171094.

Product Purchases

In order to make a purchase through the PURE website you will be required to register. When you register, you will be required to provide information about yourself including, but not limited to, your name, telephone number and email address, which is true, accurate, current and complete in all respects. Should any of your registration information change in future, you are required to amend your personal online account immediately. We may change registration requirements from time to time.

If you use the website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.

When ordering items, you will be required to provide payment details and you represent and warrant that the payment details you provide on ordering are both valid and correct and you confirm that you are the person referred to in the billing information provided.

The purchase of merchandise through the PURE website is strictly limited to parties who can lawfully enter into and form contracts on the website in accordance with Scottish law. PURE reserves the right to refuse access to the website, terminate accounts, remove or edit content, or cancel orders at our discretion. If we cancel an order, it will be without charge to you.

Gift Vouchers

Gift vouchers are valid for ten months from date of purchase. PURE gift vouchers can be redeemed for treatments at any of the PURE and PURE Spa locations in Edinburgh, Glasgow and Aberdeen. Unfortunately gift vouchers cannot be used to purchase items from the PURE website. PURE Spa Therapy vouchers and Spa Gift Experiences can only be redeemed at PURE Spa, Ocean Terminal, Edinburgh, Silverburn, Glasgow or Union Square, Aberdeen. Gift vouchers can only be redeemed for the monetary value or treatment written on the voucher. The treatment suggestions given for the redemption of gift vouchers is an indication only. PURE reserves the right to alter its pricing or substitute or withdraw treatments at any time without further notice. Gift voucher purchases are non-refundable and cannot be replaced if lost or stolen. This does not affect your statutory rights.

Spa Offer Vouchers

Delivery of your spa offer voucher (‘Service’) will be made to the email address you provided when joining. We aim to deliver your Service promptly but we do not promise that delivery or access will happen immediately nor are we liable for any problems, delays or losses in respect of delivery or access arising out of any cause beyond our control.

Without limitation, we shall not be responsible for any problem you may experience with the Services due to the act or fault of any telecoms provider, internet service provider and/or technology supplier; systems maintenance (we shall try to keep this to a minimum and outside of peak hours, wherever reasonably possible); any incompatibility or technical fault in respect of your computer hardware software and/or systems and/or mobile phone; your joining details are inaccurate or out-of-date; your email in-box or your phone message mailbox is full; you are not following any instructions we give you for using the Site or accessing the Services; your mobile phone is out of range or for some other reason cannot be contacted or any other circumstance where we send you or grant you access to a particular Service but you are unable to receive it through no fault of our own.

Further, the Service is subject to the limitations of the enabling technology on which it is reliant and may be adversely affected by network performance and other operational factors beyond our control including without limitation congestion, network coverage, dropped connections, the performance of your own device and the maintenance and support of secure network connections. We accept no responsibility if you do not receive the Service for any of these reasons. If for any reason we are unable to supply a particular Service, we will endeavour to inform you as soon as possible. We reserve the right to permanently withdraw any Services, in which event you will be entitled to a refund of any fees already paid by you to the extent that the fees relate to use of the Services following the withdrawal date.

Electronic Vouchers

Electronic vouchers are vouchers that are sent by email to the email address that you provided to PURE when you registered, instead of sending a paper voucher through the post. Electronic vouchers are deemed to have been received when they are sent, and are bound by the clauses above. Electronic vouchers have built in security to ensure their safe use, but once they have left the PURE website, you are wholly responsible for the safekeeping of your voucher. VOUCHERS SHOULD BE TREATED AS CASH. Delivery on Electronic vouchers can take up to 24 hours (excluding public holidays inc. Christmas day and New Years day).

PURE cannot accept responsibility for lost, stolen, fraudulent use, or any other unauthorised use of the voucher. Once the voucher has been redeemed and is noted as redeemed in PURE’s voucher system, it will be cancelled. The voucher is valid for the treatment, location, and within the expiry date listed on the voucher only. The voucher is valid for one visit only.

Reproduction, sale, resale or trade of a Voucher is prohibited. Any attempt to carry out any of these will potentially void the Voucher at our discretion. If the Voucher is redeemed for less than its face value, there is no entitlement to a credit, cash or new Voucher equal to the difference between the face value and the amount redeemed. Also, Vouchers are redeemable in their entirety only and may not be redeemed incrementally.

Availability

All items are subject to availability. Validly stated prices on our website remain in effect for so long as the merchandise is available or as otherwise stated on our website. We will inform you as soon as possible if the goods you have ordered are not available.

Ordering Errors

You are able to correct errors on your order up to the point at which you click on 'confirm order' on the final page of our ordering process.

Delivery

Deliveries can only be made within the UK.

We will deliver the merchandise in accordance with the delivery option selected by you. Please view our delivery section for full details. Whenever referred to, working days exclude Saturday, Sunday and Bank Holidays. Any delivery timescales are indicative only.

Upon delivery of the merchandise to you, we will provide you with sufficient information to enable you to exercise your statutory right of cancellation or to return or exchange your merchandise. For further information please see the returns and the cancellation right sections within these terms and conditions.

Acknowledgement and Acceptance of Your Order

We will notify you by email as soon as possible to acknowledge receipt of your order and to provide you with an order number. If we are unable to fulfil your order following this acknowledgement, we will contact you by email or telephone advising you of this. Our acceptance of your order will take place upon despatch of the product(s) ordered. If you require any information concerning your order please email us at lothianroad@purespauk.co.uk quoting your order number. We may not accept your order if an item you have ordered is out of stock, if we have identified a product or pricing error or if we are unable to obtain authorisation for your payment. Please note that we reserve the right to reject any offer to purchase by you at any time.

Inspection

You should inspect the product(s) upon receipt and check that everything specified on the delivery note is included. You will be deemed to have accepted the order unless you notify us upon receipt that there is a problem or you cancel the order in accordance with your cancellation right and/or you return the goods in accordance with our returns policy and procedure. If you fail to take such action, we are not obligated to accept any rejection by you of the product(s) at a later date. Your statutory rights are not affected.

Payment

Payment can be made by any of the following methods: American Express, Visa, Mastercard, Delta, Electron, Solo, JCB, Maestro and Switch. Payment will be debited and cleared from your account at the point at which your order is despatched. You confirm that the credit or debit card being used is yours. Please note that all credit/debit cardholders are subject to validation checks and authorisation by the issuer of the card. If the issuer of your payment card refuses to pay or does not for any reason authorise payment to PURE, we will not be liable for any delay or non-delivery of merchandise. We retain the legal ownership of all merchandise until full payment has been made by you and received by us and legal ownership of the merchandise will immediately transfer back to us if we refund any payment for the merchandise to you. Risk in the merchandise transfers to you upon delivery.

Legally Binding Contract

Please remember that when we accept your submitted order for merchandise on this website, there will be a legally binding contract.

Cancellation Right

Under the distance selling regulations you have the legal right to cancel your order within seven working days from the date of receipt of the goods if you send us a notice of cancellation in writing and return the goods to us in their original, unopened and unused condition. For further details of how to return merchandise please see our returns policy and procedure. Where goods are delivered to a third party you may exercise your right to cancel if you are able to return the merchandise to us. You can submit your cancellation notice by email to lothianroad@purespauk.com or in writing to PURE, 138 Lothian Road, Edinburgh, EH3 9BG. Your statutory rights are not affected.

Returns

PURE hopes that you will be delighted with your order. However, if for any reason you are not completely satisfied with any products you have ordered please return it to PURE within 21 days of your receipt of goods. This does not apply to gift vouchers, which are non refundable. We unfortunately and without exception cannot accept any returns unless they are in their original, unopened and unused condition. When items are purchased as a set, we can only accept returns of complete sets, not individual items. Refunds for products bought as gifts can only be given to the original purchaser. Please view our returns policy and procedure for full details of how to return your goods. Your statutory rights are not affected.

Accuracy of Content

We have taken great care in the preparation of the content of this website, in particular to ensure that the details, descriptions and prices quoted are correct at the time of publishing. However, we will only accept orders if there are no material errors in the description of the merchandise or its price as advertised on this website. All prices are displayed including VAT and exclusive of delivery charges. The total cost of your order is the price of the merchandise ordered plus VAT at the current rate and delivery charges as set out in the delivery and returns section of this website.

The packaging may vary from that shown. Any weights and dimensions quoted are approximate only. We have made every effort to display as accurately as possible the colour of the products that appear on the website. However, as the actual colours you see will depend on your personal computer equipment, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the merchandise on delivery. To the extent permitted by applicable law, PURE disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. We are not responsible for the content of any off-website pages or any other websites linked to or from this website. Links appearing on this website are for your convenience only and are not an endorsement by us of the content, products, services or suppliers connected therewith. We shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website, in any off-website or in any linked websites.

Privacy Policy

PURE values its customers and respects their privacy. Your visit to our website and your use of any of the services or features we provide is subject to our terms and conditions of which this privacy policy is a part.

You will be asked to register if you would like to use some of the services and features we offer on our website. In order to register we ask you to provide details including your name, address, telephone number and email address. When you register with us this information is stored in 'my account'. You can access 'my account' directly to amend any personal details, for example if you change your address. If you wish to place an order on our website you will also be required to provide credit or debit card details via a secure server.

These disclaimers and exclusions shall be governed by Scottish law. If any provisions of these disclaimers and exclusions are deemed to be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
